Pineda <br />Director <br />RE: Reason to Believe a Violation Exists at the Cash and Who Do Mines; DRMS File No. <br />M- 1983 -141 <br />On August 24, 2011, the Division of Reclamation, Mining and Safety (Division) conducted an <br />inspection of the Cash and Who Do Mines located 10 miles northwest of Boulder, Colorado and <br />found the following: <br />The Operator has constructed a secondary escape -way hatch which is located outside of the <br />permit boundary; the total disturbed area is approximately 100 ft The 3rd level adit is <br />discharging mine water and the Operator has not obtained a discharge permit from the Colorado <br />Department of Public Health and Environment. In addition, the Operator has failed to provide the <br />Division with the Annual Water Monitoring Report for 2009 and 2010. <br />• C.R.S. 34- 32- 116(7)(h) for failure to protect areas outside of the affected land from <br />damage occurring during the mining operation and reclamation. <br />• C.R.S. 34- 32- 116(7)(g) for failure to minimize disturbance to the prevailing <br />hydrologic balance of the affected land and of the surrounding area and to the <br />quality and quantity of water in surface and groundwater systems; AND /OR <br />Hard Rock Rule 3.1.6(1)(b) for failure to comply with applicable federal and <br />Colorado water quality laws and regulations, including statewide water quality <br />standards and site - specific classifications and standards adopted by the Water <br />Quality Control Commission. <br />n445 2 1A) <br />Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
