RE: Reason to Believe a Violation Exists at the Cash and Who Do Mines; DRMS File No.
M- 1983 -141
On August 24, 2011, the Division of Reclamation, Mining and Safety (Division) conducted an
inspection of the Cash and Who Do Mines located 10 miles northwest of Boulder, Colorado and
found the following:
The Operator has constructed a secondary escape -way hatch which is located outside of the
permit boundary; the total disturbed area is approximately 100 ft The 3rd level adit is
discharging mine water and the Operator has not obtained a discharge permit from the Colorado
Department of Public Health and Environment. In addition, the Operator has failed to provide the
Division with the Annual Water Monitoring Report for 2009 and 2010.
• C.R.S. 34- 32- 116(7)(h) for failure to protect areas outside of the affected land from
damage occurring during the mining operation and reclamation.
• C.R.S. 34- 32- 116(7)(g) for failure to minimize disturbance to the prevailing
hydrologic balance of the affected land and of the surrounding area and to the
quality and quantity of water in surface and groundwater systems; AND /OR
Hard Rock Rule 3.1.6(1)(b) for failure to comply with applicable federal and
Colorado water quality laws and regulations, including statewide water quality
standards and site - specific classifications and standards adopted by the Water
Quality Control Commission.
