Mr. Wallace H. Erickson
Response to Fifth Adequacy
September 9, 2011
Page 6
properly located in relationship to topography. Additionally, the contour
lines show the natural pre- mining topography, prior to the
commencement of historic mining activities, and fail to show any of the
existing highwalls, mine benches, and access roads. At 5 -foot contour
interval, such mine features should be readily apparent. Figure C -3 does
not accurately display the existing topography. Please submit a correct
Figure C -3.
Response to Adequacy Issue No. 4.
Response to Adequacy Issue No. 4.a.
Wildcat intended to include a 50 -foot wide corridor for all roads. Wildcat has
used a 50 -foot wide corridor for all roads since its November 8, 2010 Response to
Completeness Matters. See Response to Completeness Item No. 3 (Nov. 8, 2010)
( "Please note that all road buffer zones have been increased to 50 feet .... "). Several
maps in the August 8, 2011 submittal inadvertently showed a 100 -foot wide corridor.
This error was due to a misunderstanding of the individuals preparing the maps. Wildcat
has corrected all maps listed showing greater than 50 -foot wide corridors to reflect the
proper 50 -foot corridors. See Attachment 3.
Response to Adequacy Issue No. 4.b.
Wildcat has corrected Figures D -1, D -2, D -1 of Attachment D -2, D -1 of
Attachment D -3, D -1 of Attachment D -4, F -1, F -2, F -3, F -4, and F -5A to show a 50 -foot
road corridor. See Attachment 3. See also supra Response to Adequacy Issue No. 4.a.
Response to Adequacy Issue No. 4.c.
Wildcat has corrected CLC drawings C4.11, C4.12, C4.13, C4.14, C4.21, C4.22,
C4.23, and 07.00 to show a 50 -foot road corridor. See Attachment 3. See also supra
Response to Adequacy Issue No. 4.a. Wildcat notes further that since its November 8,
2010 Response to Completeness Matters, it has shown the road corridor for the New
Access Road as approximately 50 feet wide. See Response to Completeness Item No. 3,
Attachment 1, Ex. E. ( "This road base area is approximately 50 feet wide . . . .") & Ex.
C -1 (showing New Access Road with variable road corridor approximately 50 feet
wide).
DEN 97,599,531v1 9 -9 -11
GREENBERG TRAURIG, LLP • ATTORNEYS AT LAW • WWW.GTLAW.COM
