Erickson
Response to Fifth Adequacy
September 9, 2011
Page 3
Table 1: Affected Land Acreages as provided in Exhibit A of the Application
Pursuant to Rule 1.1(6), the August submittal constitutes an Amendment to CN -01. If
the Applicant intended to expand the boundary of affected lands, please complete the
filing process as required for the previous amendment to CN -01, filed April 27, 2011.
Alternately, if the Applicant did not intend to expand the boundary of affected lands,
please correct the application to reflect no increase in affected lands.
Response to Adequacy Issue No. 2.
Wildcat has not added any new affected lands to its application. Wildcat is
submitting as Attachment 2 a chart demonstrating that it has not added any affected
lands and explaining how it has calculated acreage. The majority of the discrepancies
identified by DRMS relate to Wildcat's inadvertent inclusion of a 100 -foot road corridor
for certain roads. See infra Response to Adequacy Issue No. 4. The remaining portion
of the acreage discrepancy relates to Wildcat's use of more accurate survey data to
calculate acreage. Wildcat's mapping of affected lands has remained consistent.
Wildcat is also presenting a revised Exhibit A (Attachment 4) and Figure C -4
(Attachment 3) reflecting its clarification to affected land acreage.
DEN 97,599,531v1 9 -9 -11
GREENBERG TRAURIG, LLP • ATTORNEYS AT LAW • WWW.GTLAW.COM
