XVII. Rule 4.17 Air Resource Protection <br />The Colorado Department of Public Health and Environment (CDPHE) administers emission <br />permits. However, air emission permits for the Keenesburg Strip Mine have been canceled, and <br />reclamation activities were re- designated to Air Pollution Emission Notice (APEN) required <br />status. <br />XVIII. Rule 4.18 Protection of Fish, Wildlife and Related Environmental Values <br />There are no fish, and there is no fish habitat, on the site. Impacts to as many as 50 species of <br />mammals, birds, and reptiles are described in the permit, as well as their recovery after <br />reclamation (PAP, Section 2.04.11). There are no known endangered species in the area. <br />XIX. Rule 4.19 Protection of Underground Mining <br />There were no underground mining activities at the site, and none are planned [Rules 4.19(1) and <br />4.22.4(1)]. <br />XX. Rule 4.20 Subsidence Control <br />No potential for subsidence exists at the site, thus no control plan is required. <br />XXI. Rule 4.21 Coal Exploration <br />There is no longer any coal exploration on site. <br />XXII. Rule 4.22 Concurrent Surface and Underground Mining <br />There has never been underground mining at the site. Furthermore, all mining has ceased at the <br />site, and there are no plans to re- initiate mining. <br />XXIII. Rule 4.23 Auger Mining <br />There was no auger mining at the site, and none is planned. <br />XXIV. Rule 4.24 Operations in Alluvial Valley Floors <br />The Division concurred that there is no alluvial valley floor on the site (PAP, Section 2.06.8, <br />page 130). <br />XXV. Rule 4.25 Operations on Prime Farmland <br />The Division concurred that there is no prime farmland within the permit boundary (PAP, <br />Section 2.04.12, page 100). <br />20 <br />
