•
•
Tables 14 and 15 do not include evaporative depletions from ponds in the Cyprus area because
their exact location was not known. Some of the ponds will be tributary to the San Miguel River.
The evaporative depletions will be determined when the location and size of the ponds are
known.
CONCLUSIONS
This report has properly identified the depletions associated with the Western Fuels coal mine,
both present and in the future area of NHN and partially Cyprus. It also corrects both depletions
and CU credits associated with 88CW55 and permanently assigns the location of 74 acres of dry
up so that augmentation plan can be revised. If uses at the mine are in compliance with the
revised augmentation plan, including changing the additional 34 shares to industrial and
augmentation uses, then no injury will occur to any nearby wells or surface water rights.
Is! - Wayne I.
