Our review assumes that the construction material <br />borrow area, borrow areh topsoil stockpile, and Pond 4 are removed from the plan and that <br />permit text, designs and maps are revised accordingly. The Division has the following adequacy <br />concerns and comments based on your responses to the items listed in our June 21, 2011 second <br />adequacy review letter. Please note that there are several new questions as a result of the recent <br />plan changes. These are Items 47.1 through 47.15 and Item 74a. <br />Rule 2.03 Legal, Financial, Compliance and Related Information <br />la-e. Items resolved. <br />1f. As of April 28, 2011, Henry Scholder had not been removed from AVS. Please have <br />AVS updated accordingly. <br />CAM - The update of AVS is in progress <br />Division Response: As of August 4, 2011 Henry Scholder is still listed as a Vice President of <br />Wexford Capital LLC in AVS. Please provide information to the AVS administrator so that <br />the system can be updated, or revise Page 2.03 -19 to include Henry Scholder as an officer of <br />Wexford Capital LLC. <br />1 g -h.
