Pineda <br />Director <br />Resolution: <br />This item is in regards to a Notice of Possible Violation, Cease and Desist Order, corrective actions and <br />civil penalties for failure to obtain a Reclamation Permit from the Board or Office before engaging in a <br />new mining operation. Colorado Land Reclamation Act for the Extraction of Construction Materials, <br />C.R.S. 34- 32.5 -101 et. Seq., and specifically 34- 32.5- 109(1). <br />The operator affected approximately 2 -3 acres outside the current 110c approved permit area during <br />construction of an unpermitted road proposed to provide access to their current 110c pit that is currently <br />being converted to a 112c operation. It is the operator's responsibility to obtain a Mined Land <br />Reclamation Permit before engaging in a new operation. <br />Chronology: <br />• March 4, 2011 — United Companies of Mesa County submitted a 110c to 112c conversion <br />application for Permit No. M- 1986 -002. <br />• August 1, 2011 — the Division was contacted by United Companies concerning an access issue <br />related to the proposed 110c to 112c conversion of Permit No. M- 1986 -002. <br />• August 2, 2011 — the Division conducted an inspection of the site and noted a new access road <br />and improvement of an existing road, both constructed to support the proposed mining <br />operation. <br />o The current Craig Ranch 110c Permit is approved for 8.4 acres of disturbance. <br />o The Division estimates that a total of 2 -3 acres of disturbance has occurred outside of <br />the current 8.4 acre 110c Craig Ranch Pit permit area and outside the proposed 112c <br />affected area. <br />• August 4, 2011 — the Division mailed a Reason to Believe a Violation Exists letter (RTB). <br />• August 16, 2011 — The Division mailed the August 2, 2011 inspection report to the operator. <br />• August 19, 2011 — United Companies contacted the Division to discuss the possible violation and <br />possible corrective actions. <br />Office of <br />Active and Inactive Mines <br />
