PAWa <br />Meeker, CO 81641 <br />Director <br />RE: Colowyo Coal Mine, C 1981 -019, Permit Revision No. 3, Fourth Adequacy Review Letter <br />Dear Mr. Blunt: <br />The Division found Colowyo Coal Company, LLC's (CCC) application for a Permit Revision (PR3) <br />for mine expansion and mining in the Collom area complete on December 27, 2010. The Division <br />reviewed the application and provided CCC with a preliminary adequacy review on February 25, 2011. <br />CCC responded to the Division's preliminary adequacy concerns on March 28, 2011. The Division <br />reviewed CCC preliminary adequacy review responses and provided a second adequacy letter on April <br />22, 2011. CCC provided a second adequacy review response on May 23, 2011. The Division sent <br />CCC a third adequacy letter on July 22, 2011. CCC provided responses to the third adequacy letter on <br />August 9, 2011. The Division has the remaining concerns as a result of our review of the third set of <br />adequacy responses. <br />For the record, the original questions have been restated. The format is the same as the original three <br />adequacy letters. However, to reduce redundancy, adequacy items that have been resolved have not <br />been repeated in this letter. Only the remaining adequacy concerns have been restated in this letter. <br />Rule 2.04.7(]) Groundwater Information <br />the application remains inadequate. DRi%IS lit c% asked CCC to please provide evidence <br />that demonstrates Colo%%Vo owns or Controls %%ells owned by others. This C%idcnce was not <br />provided. <br />It appears that the application remains inadequate. DRMS previously asked CCC to provide <br />evidence that demonstrates Colowyo owns or controls wells owned by others, in particular the <br />Sweeney and Dudek wells (names in State DW R registry). The evidence provided by CCC <br />( "Deed, Bill of Sale and Conveyance" with Exhibit A listing locations of properties purchased <br />by CCC), does not appear to resolve the issue. The Sweeney and Dudek wells are located in <br />four sections that are not listed in Exhibit A.
