The Division has used the definition of "project amount" and "contract amount" to mean the amount <br />that it would cost a contractor to complete reclamation of a mine site. This amount necessarily <br />includes the additional costs for public liability insurance, a performance bond, a job superintendent <br />and contractor profit. The Division then applies the additional necessary costs for engineering work <br />and /or contract/bid preparation and reclamation management and/or administration line items to this <br />contract or project amount, based on Means. While this method may differ slightly from the OSM <br />method of calculating reclamation cost estimates, the Division believes that the method it uses is <br />correct and the methodology is supported by the Act, the Rules and Means. <br />The Division would appreciate any further comments that you may have on this matter and a response <br />as to the request for an informal conference to TCCs concerns regarding this matter within 30 days of <br />the date of this letter. <br />If you have any questions feel free to contact me.
