• <br />• <br />• <br />Exhibit S - AMENDMENT 4 <br />Permanent Man -Made Structures <br />Permanent man -made structures are located within 200 feet of the affected land. These structures are owned <br />by others, who are neither the land owner nor the operator, and are located on the north and east sides of the <br />Phase 7 mining area. The structures include fences, corrals, sheds, poles, concrete culverts, asphalt pavement, <br />and water wells. <br />The west side of the Phase 7 area is owned by the landlord and contains structures owned by the operator. The <br />south side of Phase 7 is bordered by a strip of land of at least 200 feet and is predominantly owned by the <br />landlord. The land contains the 100 foot setback area of the mining from the Arkansas River, the River itself, <br />and the south shore of the River. No permanent man-made structures are located within this 200 foot strip of <br />land. <br />The mining operation will not adversely affect the stability of any permanent man-made structure. To prove <br />this statement, the operator has commissioned an appropriate engineering evaluation demonstrating that <br />structures will not be damaged by activities occurring at the mining operation. Refer to Appendix A (Section <br />U) for the slope stability study. <br />
