As we discussed
this morning, this is not an exhaustive list of deficiencies that still exist in the application. Rather, it is representative of
the types of issues that still exist in the application. The Division is still reviewing the over 1300 page submittal and
generating additional notes and memos, therefore, at this time, an exhaustive list of deficiencies has not been compiled.
Thus, clarifying or resolving the issues on this list will not resolve all outstanding issues contained in the application. The
Division will not be in a position to provide an exhaustive list of outstanding issues until the August 24 decision date at
which time it will be in the form of either a denial rational or, if the matter is extended, an adequacy letter.
As was discussed Friday and again this morning, the Division does not believe there is sufficient time to re- convene
technical staff for both the Division and Wildcat to discuss and resolve outstanding issues, or review additional submittals
from Wildcat, prior to the Division's August 24 decision date. Although you may not agree, the Division believes that the
issues that remain in the application are too numerous and substantial to resolve in 48 hours.
Jeff M.
