Pit, (DRMS# W81-022) (WDID 0303008) <br />NW1 /4 Section 3, T7N, R69W, 6th P.M. <br />Water Division 1, Water District 3, Larimer County <br />RECEIVEr <br />AUG2 32011 <br />Division of Reclamation. <br />Mining & Safety <br />Your letter dated June 16, 2011, requesting renewal of the above referenced substitute water <br />supply plan to cover depletions caused by an existing gravel mining operation have been reviewed. <br />The required fee of $257 for the renewal of this substitute water supply plan has been submitted <br />(receipt no. 3650764). The original plan was approved on March 26, 1993 and was most recently <br />renewed on December 15, 2009. <br />Approval Period: June 16, 2011 through May 31, 2012 <br />Contact Phone Number for Mr. Jared Dains: 303 - 452 -6611 <br />Plan Operation <br />As indicated in the previous approval letter, Connell Resources, Inc. ( "CRI ") has begun the <br />process of backfilling this site above the groundwater table to remove the long -term augmentation <br />requirement. In a letter dated April 23, 2003, the State Engineer's Office allowed the site to be <br />operated under a substitute water supply plan until such time that the pit has been completely <br />backfilled. Connell Resources, Inc. has amended their DMG permit to reflect that the groundwater <br />pond will be backfilled completely. According to the information provided, backfilling of the site <br />restarted again in August 2008. The letter indicated that the backfilling of the site in 2010 reduced <br />the exposed surface area from 4.2 acres to 1.0 acres. Note that all ground water at this site was <br />exposed after December 31, 1980. <br />Please note that the approval of this substitute water supply plan does not relieve the <br />Applicant and /or the landowner of the requirement to obtain a water court decree approving <br />a permanent plan for augmentation or mitigation to ensure the permanent replacement of all <br />depletions, including long -term evaporation losses and lagged depletions after gravel mining <br />has ceased. In the previous plan we indicated that renewal of this plan is contingent on the <br />Applicant demonstrating that the backfilling of the site has continued or contingent upon the <br />Applicant filing an application for a plan for augmentation with the Division 1 Water Court <br />that includes long -term evaporation losses at the G. L. Pit site.
