Based upon the e-mail below from Mr. Shannon Nichols of XTO Energy, it appears that XTO has some <br />unresolved concerns regarding maps submitted by New Elk Coal Company that pertain to the locations of XTO gas wells <br />and pipelines within the New Elk Coal Mine's permit area. Please submit therefore a request for an extension of the PR- <br />02 Decision Due Date from today to Friday, August 5 2011, to allow sufficient time for New Elk Coal Company to <br />resolve XTO's concerns, and for the Division to complete our review of the application, including our review of any <br />updates to the proposed PR -02 maps, structure inventory, and subsidence control /mitigation plan that may need to be <br />revised so as to resolve XTO's concerns. <br />Thank you, <br />Dan <br />1 <br />
