This report documents observations concerning compliance with the terms of the permit <br />and applicable rules and regulations of the Mined Land Reclamation Board. <br />NSPECTION TOPIC: Off - site Damage <br />The following inspection topics were identified as having Problems or Possible Violations. OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />•OSSIBLE VIOLATION: The Operator has failed to comply with the February 9, 2011 Board Order. This is a <br />.ossible violation pursuant to C.R.S. 34- 32.5 -124 and C.R.S. 34- 32.5 -118 (a) (b), for failure to comply with the <br />onditions of an Order. <br />: ORRECTIVE ACTIONS: Two Formal Public Hearings will be held in regards to this issue. The first will occur at the <br />.ugust 10 and 11, 2011 Board meeting for consideration of the possible violation, as discussed above. Also at <br />its hearing, it will be determined if the Board has the authority to revoke the permit held for the operation and <br />'rfeit the financial warranty. If at the August hearing the Board determines it has the authority to revoke the <br />ermit and forfeit the financial warranty a second Board hearing will take place. The second hearing will occur <br />uring the September 14 and 15, 2011 Board meeting in order to revoke the permit and forfeit the financial <br />'arranty. <br />ORRECTIVE ACTION DUE DATE: 8/10/11 <br />Page 1 of 4 <br />
