Pineda <br />Director <br />TO: File <br />FROM: Mike Boulay <br />DATE: August 16, 2011 <br />SUBJECT: Fruita Loadout (Permit No. C- 2010 -088) <br />Phone Conversation with Paul Creeden Colorado Division of Wildlife (CDOW) <br />Paul Creeden District Wildlife Manager for CDOW's Northwest Regional Office called me at <br />10:30 am on August 15, 2011 to discuss the Fruita Loadout project. He wanted to follow up on my <br />recent correspondence to JT Romatzke, Area Wildlife Manager following CAM's second <br />response submittal and on the field trip to Fruita Loadout in which Daniel Neubaum of their office <br />attended. Paul indicated that they would have no further comments on the Fruita Loadout project. <br />Paul said that the BMPs and sediment control as proposed would be sufficient and that the U.S. <br />Fish & Wildlife involvement with preparation of a Biological Opinion (combined action with <br />McClane Canyon Mine) would satisfy their concerns for the Fruita Loadout but that they still had <br />comments pending on the McClane Canyon Mine expansion. Further he mentioned that they had <br />considered requesting a fence along the rail line loop to protect the river otter but that on further <br />consideration decided not to pursue that: The reason being that the train will move so slowly along <br />the rail spur they didn't feel that it was necessary also given the fact that the adjacent rail line has <br />no fencing. We discussed the plan changes to the bridge over Reed Wash and that proper <br />mitigation during bridge construction would alleviate potential impacts and satisfy their concerns. <br />Paul concluded that CDOW would have no further comments on the proposed Fruita Loadout <br />project.
