DEPARTMENT OF NATURAL RESOURCES <br />DIVISION OF WATER RESOURCES <br />August 15, 2011 <br />Janet Binns, Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Dear Ms. Binns: <br />Re: Edna Strip Mine (Permit No. C 1980 - 001 pivision of Reclamation, <br />Permit Renewal Application No. 6 Mining & Safety <br />The Division of Water Resources has reviewed the Edna Strip Mine (Permit No. C -1980- <br />001) Permit Renewal Application. The Permit Renewal Application requests renewal of the <br />existing permit pending final (Phase III) bond release for the remaining portions of the mine. No <br />additional mining is proposed for this permit term; the applicant is only proposing maintaining <br />the current reclamation. The coal mining operation is located approximately 5 miles Northwest <br />of Oak Creek Routt County. The State Engineers Office (SEO) offers the following comments <br />on this project: <br />It appears the applicant impounds water collected from storm or surface water drainage. <br />Currently, the stream system in this location is not overappropriated, however, if the stream <br />system at this location becomes overappropriated, the storage and use of any surface or ground <br />water will be subject to administration. <br />The applicant should be aware that if they wish to keep any existing water wells on the <br />site after final bond release, appropriate water well permits will be required from the SEO. <br />Thank you for the opportunity to comment on this project.
