PUBLIC NOTICE
<br />New Elk Coal Company, LLC, 122 West First St., Trinidad, Colorado 81082, the operator
<br />of the New Elk Mine, Permit number C- 1981 -012, is filing for a technical revision (TR -59) to the
<br />mining permit with the State of Colorado, Division of Reclamation, Mining and Safety. For filing
<br />purposes, this application was deemed complete by the Division on MONTH DAY, YEAR.
<br />The New Elk Mine is located approximately 7 miles west of Weston, Colorado, on State
<br />Highway (Hwy) 12. The Jansen Yard is located immediately south of the town of Jansen,
<br />Colorado. The mine permit boundary is located within sections 13, 14, 21, 22, 23, 24, 25, 26,
<br />27, 28, and 35, T33S, R68W. The Jansen Yard is located within sections 22 and 23, T33S, R64W.
<br />The combined permit boundary contains 1,631 acres, more or less. These sections can be
<br />located on the USGS 7.5 minute Vigil, Stonewall, Tercio and Trinidad quadrangle maps.
<br />Portions of the proposed underground mine and surface support of the underground mine lie
<br />within the boundary of the Bosque del Oso State Wildlife Area. A total of 209.1 acres of surface
<br />disturbance from mining - related activity is covered by a reclamation bond in the amount of
<br />$3,824,698.
<br />This technical revision will incorporate the C &W Train Shop, the 10 -Stall Garage and the
<br />C &W Trains Sand Loading Building and associated structures and stored materials into the
<br />approved permit. This technical revision application also provides for the installation of a 200 -
<br />feet (ft) -long rigid conveyor at the end of the existing refuse conveyor along with a 500 -ft-long
<br />portable conveyor and two 150 -ft-long radial stackers.
<br />A 0.6 acre incidental permit boundary revision is also part of this technical revision. The
<br />approved permit boundary will increase from 1,631 acres to 1,631.6 acres. The disturbed area
<br />will increase 6.0 acres from 209.1 acres to 215.1 acres.

<br />information may be obtained from the Division of Reclamation Mining and Safety at the above
<br />address. Written comments must be received by the Division of Reclamation, Mining and
<br />Safety within 10 days after the date of this publication in order to be considered.
