Dear Mr. Zuber: <br />cc: <br />DEPARTMENT OF NATURAL RESOURCES <br />DIVISION OF WATER RESOURCES <br />Robert Zuber, Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />August 11, 2011 <br />Re: Trapper Mine (Permit No. C- 1981 -010) Response <br />Technical Revision Application No. 108 <br />The Division of Water Resources has reviewed Graham Roberts' response, dated July 14, 2011, <br />to our previous comments on the Trapper Mine (Permit No. C- 1981 -010) Technical Revision Application. <br />The applicant proposes to insert the 2010 Annual Reclamation Report for the Trapper Mine as Appendix <br />W in the Trapper Mine permit. The coal mining operation is located approximately 6 miles southwest of <br />Craig in Moffat County. The State Engineers Office (SEO) offers the following comments on the <br />applicant's response: <br />Though we agree with most points in the response, we would like to clarify the need for well <br />permits on sites regulated by DRMS. All wells operating within DRMS permitted sites that are being used <br />with the intent of accessing ground water, including wells used for the monitoring and observation of <br />water quality /levels, are still subject to the State Engineer's Office (SEO) well permitting requirements. <br />Exploration boreholes constructed /used for purposes other than accessing ground water do not require <br />notice and /or permitting through the SEO; however these wells will require permits through the SEO <br />if /when they are used to access ground water for monitoring or other purposes. Wells that are drilled as <br />exploration boreholes under MLR and are later used for water monitoring wells are exempt from the <br />Water Well Construction Rules, 2 CCR 402 -2 (WWCR). <br />Thank you for the opportunity to comment on this project.
