OBSERVATIONS <br />PERMIT #:. M -1979 -166 <br />INSPECTOR'S INITIALS: THM <br />INSPECTION DATE: July 14, 2011 <br />This inspection was conducted as part of the normal monitoring program established by the Colorado Division <br />of Reclamation, Mining and Safety (Division). The Bennett's Gravel Pit is located approximately 4 miles west <br />of Delta, Colorado south of U.S. Highway 50. The site is a 112c operation with 32.6 permitted acres, only 29 <br />acres is allowed to be affected. Gayle Lyman, a representative of Elam Construction, Inc. was present during <br />the inspection. <br />The site is inactive during the inspection. Various stockpiles of construction material were observed throughout <br />the process area. The perimeter of the permit area was walked and no evidence of offsite damage was observed. <br />The extent of the permit area adjacent to the Gunnison River was taking in river water at the time of the <br />inspection due to the high flow from snow run off. The strip of land between the permit and river showed signs <br />of erosion from the high water level and will likely require repairs once the water level recedes. There appeared <br />to be no sign of permanent river capture observed at the location where river water entered the pit. <br />In an effort to ensure that the financial warranty remains adequate to reclaim the site per the requirements of the <br />approved reclamation plan, DRMS has updated the reclamation cost estimate (copy enclosed). Therefore <br />pursuant to Sections 34- 32.5- 117(4) of the Colorado Land Reclamation Act, adequate financial warranty must <br />be submitted to the DRMS within 60 days of the mailing date of this report.
