Page 4 of 8 <br />Jeffrey Clark <br />August 8, 2011 <br />The Applicant's Fulton Ditch shares are either delivered directly to the South Platte River <br />or stored and released later, depending upon the season. The shares will be delivered down <br />either the lateral (Erger Lateral) that historically served the Bromley Lakes site or either of the <br />City of Brighton's ( "Brighton ") Fulton Ditch augmentation stations (Midland or 124 Avenue). <br />RMCC will measure the delivery of the shares through the Erger's Lateral prior to release to the <br />river for replacement of depletions or to storage. Brighton will measure the Fulton Ditch <br />deliveries at these augmentation stations and account from RMCC's deliveries separately. <br />RMCC is still in the process of finalizing an agreement with Brighton for the delivery of the <br />Fulton Ditch shares through the augmentation stations listed above. A copy of the finalized <br />agreement must be submitted to the State Engineer's Office once obtained. <br />The historical consumptive use credit of Fulton Ditch shares is based on 1.76 acre -feet <br />per share as determined in the South Adams County Water and Sanitation District ( "SACWSD ") <br />change case engineering report prepared for Division 1 Water Court case no. 2001 CW258. The <br />70 shares would yield a total consumptive use yield of 123.2 acre -feet. You have proposed to <br />calculate the historical consumptive use replacement credit from the shares as the lesser of <br />1.76 acre -feet per share (distributed monthly based on the SACWSD engineering report) or the <br />total Fulton Ditch deliveries multiplied by the monthly consumptive use factors, calculated as 1 <br />minus the summertime return flow factors presented in the SACWSD engineering report. The <br />distribution of the average historical consumptive use of the Fulton Ditch shares is shown in <br />Column 14 of the attached Table 1B. The historic yield of these Fulton Ditch shares will exceed <br />the depletions in August 2011 and August 2012, and July 2013, and will require replacement of <br />historic return flows in the winter months of November through March. The excess yield from the <br />Fulton shares will be placed into storage in Kenneth Mitchell Lake for later release to the river <br />during the fall and winter months, as shown in Table 1 B. RMCC has obtained an agreement <br />with the City of Brighton to store up to 200 acre -feet of water in Kenneth Mitchell Lake. <br />Additional replacement requirements will be met by water that RMCC already has in <br />storage. Releases from storage for replacement purposes are shown in Table 1B, column 18. <br />The RMCC portion of evaporation from Kenneth Mitchell Lake was estimated based upon <br />conservative storage projection provided by the City of Brighton. <br />RMCC has also obtained a lease from the City of Brighton for up to 250 acre -feet of <br />water per year through December 2012. Deliveries will be made to the downstream calling right <br />from Kenneth Mitchell Lake, 124 Avenue Storage Reservoir or at either their Midland or 124 <br />Ave Fulton Ditch augmentation stations. The lease water projected to be used under this plan is <br />89.5 acre -feet for year 1, and 183.1 acre -feet for year 2, as shown in column 20 of Table 1 B. <br />RMCC plans to renew their current lease to provide for replacement deliveries through <br />December 2013. A copy of the lease renewal must be submitted to the State Engineer's <br />Office once obtained. <br />In addition to the replacement sources listed above, RMCC is also requesting that water <br />stored under its Erger Pipeline junior water right decreed in case no. 1998CW257 be allowed to <br />be used for augmentation of the mining depletions at the sites included in this SWSP. The Erger <br />Pipeline has an appropriation date of April 15, 1998 and would only be available for diversion <br />when in priority and with prior approval of the water commissioner. <br />The monthly lagged depletions and replacement requirements for the Bromley Lakes <br />site and North Tower pit are shown on the attached Table 1 B. <br />
