Since the Mine is a DMO, the Division directed Cotter to file a EPP for the <br />Division's approval. R:00868 -869. Cotter submitted a EPP in August 2009 and <br />a revised EPP in April 2010. R:00869. Ultimately, the Division found both the <br />August and April proposed versions of the EPP inadequate. R:12 -18, 00425, <br />00869. <br />The Division inspected the Mine site again on May 18, 2010. R:00869. <br />The Division found uncontrolled water flowing from the Mine to Ralston Creek. <br />R:00869, 00871, 00879, 01012; see pictures of flow at R:00434 -435; see also <br />R:00981, 00997 -999 (Cotter acknowledges water flow). The Division also found <br />that uranium concentrations in Ralston Creek were "consistently exceeding <br />receiving stream standards," concluding that "two mine related events appear to <br />have directly led to significantly increased levels in the receiving stream. These <br />events are the cessation of water treatment ... and the cessation of water <br />recirculation from Sump <br />underground mine pool "might also be a contributing factor." R:00337. <br />The Division sent Cotter the May 2010 Inspection Report with a Notice in <br />which the Division advised Cotter that its failure to minimize the disturbance to <br />the prevailing hydrologic <br />No. 1." R:00337. The Division also stated that the <br />balance was a potential violation of the Act and <br />directing Cotter to take corrective actions. R:00346- 00352.
