The Board also ordered Cotter to pay a civil <br />penalty of $55,000 (for 5 <br />dewatering portions of t <br />1, 2010; (b) reinitiate mine dewatering and water <br />protection, treatment and monitoring; and (d) submit a <br />5 days of violation at $1,000 per day), but suspended all <br />but $2,500 if Cotter complied with the Board's Order. R:01048 -1049. <br />Following the July 12, 2010 hearing, the Board issued a written order on <br />August 11, 2010 ( "Order "). R:00845 -55. The Board's findings, conclusions, and <br />order regarding corrective actions and payment of a civil penalty are set forth in <br />the Order. The Board specifically ordered Cotter to comply with the mine <br />e Order by August 31, 2010. R:00853. <br />On August 31, 2010, Cotter filed a petition for reconsideration in regard to <br />the Board's Order. R:00712. The Board considered the petition for <br />reconsideration at its September 2010 meeting. The Board did not find <br />sufficient grounds to grant Cotter's petition for reconsideration and, therefore, <br />3 Please note that although 30 days was the initial deadline for dewatering, the Board <br />issued its Order subsequent to that date.
