We have reviewed your December 21, 2006 submittal on behalf of the
Wildcat Mining Corp., requesting approval of a substitute water supply plan
( "). This request is submitted pursuant to C.R.S. 37- 92- 308(4),
referencing the plan for augmentation applied for in case no. 06CW91, for Water
Division 7. Notice has been provided to those listed on the Division 7 SWSP
notification list That notice was sent on December 21, 2006 and no comments
were received during the 30 -day statutory review period. The required fee of
$300 has been received (receipt number 3611940).
Wildcat Mining Corp. is a small mining operation in La Plata Canyon, in La
Plata County. Wildcat has purchased a patented mining claim, and intends to
mine for gold and silver within the Idaho mine, and reopen a mill site near the
portal of the mine. A water rights application, including an augmentation plan,
has been filed in the Division 7 water court, case no. 06CW91. No decree has
been issued to date, thereby necessitating an approved SWSP from the
Colorado Division of Water Resources. Wildcat proposes to use surface water
from a nearby stream channel, where a diversion point will be established.
Water will be diverted from this structure to the mill. From the mill outlet, water
and mill waste will be conveyed to a settling pond. From the settling pond, water
will be recycled back into the mill. The milling process will result in a 100%
consumptive use of the water. Since the La Plata River is over appropriated.
Wildcat will augment depletions during periods of river call, Wildcat proposes a
pond in which augmentation water will be stored, for releases when the river is
on -call. The pond will be filled when Wildcat's water right is in priority. If
insufficient water is available for release from the augmentation pond to cover
depletions, operations at the mining site will cease.
