The decision date for this permit application is August 13, 2011. The Division of Reclamation, Mining, and <br />Safety (Division) is required to make a decision by August 13, 2011. Therefore, your response to the following <br />adequacy review concerns should be submitted to the Division as soon as possible. <br />Rule 6.3.1(3) Exhibit A - Legal Description and Location Map <br />1. This rule requires that names of all immediately adjacent surface owners of record shall be shown on the <br />location map. This information does not appear on the submitted maps. Please submit maps showing this <br />information. <br />Rule 6.3.3 Exhibit C — Mining Plan <br />2. The submitted information states, "The material will be used to supply construction rip rap and pit run to our <br />clients." Please be aware that his application is for a 111 permit and is based on the government contract with <br />CDOT for material for a state project. If the operator desires to supply material for any project other than the <br />one identified in the contract with CDOT, the operator will need to supply the additional government <br />contracts, if applicable, or apply for a 110(c) application if the material is to go to a non - governmental project. <br />Rule 6.3.5 Exhibit E — Map <br />3. This rule requires submittal of a Mine Plan map and a Reclamation Plan map. The items to be depicted on <br />these maps are described under this rule. Although the submitted application indicates these maps are <br />included and reference is made to these maps, both maps are absent from the submitted materials. Please <br />submit the required maps and take note of rule 6.2. l (2)(b) requiring the maps to be signed. <br />Please be advised that the K.W. Enterprises, LLC, East Wolf Creek PIt 111 Permit Application may be deemed <br />inadequate, and the application may be denied August 13, 2011 unless the above mentioned adequacy review <br />items are addressed to the satisfaction of the Division. Responses to these adequacy concerns must be received by <br />Office of <br />Active and Inactive Mines <br />
