On July 25, 2011, the Division received your modification to NOI No. P- 2011 -015, addressing
four additional drill holes. The Division posted the modification on the Division's website on
July 26, 2011, in accordance with the requirements of Rule 5.1.3. Any public comment
regarding the NOI must be received by the Division no later than 10 working days after the
notice was posted on the Division's website. Timely public comments must be received by the
Division no later than August 9, 2011.
On July 28, 2011, the Division received a complaint from Joe Jepson, dated July 27, 2011,
against the operation. Copy of Mr. Jepson's complaint is enclosed for your records.
The Division is reviewing the NOI and will contact you within 20 working days of the posted
date, regarding any deficiencies. Currently, the only deficiency appears to be the certification
from the Prospector that notice of the modification was submitted to the San Juan Board of
County Commissioners. Please certify that such notice was submitted pursuant to Rules
5.1.2(m)(i) and (ii).
