Box 535 <br />Somerset, Colorado 81434 <br />RE: Terror Creek Loadout, Permit No. C- 1983 -059, Terror Creek LLC. <br />Minor Revision No. 26, 2011 Midterm Updates, Completeness Review <br />Dear Mr. Kiger: <br />The Division of Reclamation, Mining and Safety has finished its review of the June 22, 2011 <br />certification letter submitted by Oxbow Carbon LLC for Minor Revision No. 26 for the Terror Creek <br />Loadout. The Division had requested additional information for completeness. However, the Division <br />did not find the certification letter satisfactory for completeness and requests the following: <br />The Division requests that additional evidence be submitted to show Crestview -Oxbow Acquisition <br />LLC (Crestview) does not control the Terror Creek Loadout. Crestview might only have a minority <br />ownership interest, but by the Division's current rules, 10 to 50 percent is considered owning of <br />record, which means Crestview could still control the operations of the Terror Creek Loadout. The <br />Oxbow Carbon letter only has one sentence stating that Crestview does not determine the manner in <br />which the Terror Creek Loadout operations are conducted.
