On this parcel the modular office <br />is identified, however, the scale, although a structure is not considered by the Assessor's <br />office. All existing structures not to be replaced on the L.G. Everist property must be <br />appropriately permitted for the use of the building or structure. <br />The Amended Flood Hazard Development Permit is a required action as delineated in the <br />Planning Department Staff report, Condition of Approval item 1.D and 1.E under the heading <br />of "Prior to Recording the Plat ". Specific text has been included herein for reference: <br />1. D The applicant shall address the requirements of the Federal Emergency <br />Management Agency, as stated in their referral response dated February 11, <br />2011. Evidence of approval shall be submitted in writing to the Department of <br />Planning Services. (FEMA, Department of Planning Services) <br />1. E The applicant shall submit an Amended Flood Hazard Development Permit to the <br />Department of Public Works for review and evaluation. (FEMA, Department of Public Works) <br />From the submitted materials, the letter dated May 2, 2011, McLaughlin Water Engineers, Ltd., <br />(MWE) to L.G. Everist, Inc. presents an argument that the Firestone Resources Mine is <br />completely out of the 100 -year and 500 -year floodplain of the St. Vrain River. This <br />determination by MWE is purportedly supported by the HEC -RAS model submitted as part of <br />the application. The modeling provided by MWE has not been reviewed or approved by FEMA <br />and as such Weld County as a participant in the National Flood Insurance Program (NFIP) is <br />unable to recognize the MWE study until written approval from FEMA is obtained. <br />Please refer to the REQUIREMENTS section of this memorandum for specific <br />instructions. <br />Building Department <br />Please refer to the REQUIREMENTS section of this memorandum for specific <br />instructions. <br />Public Works Department <br />The applicant's engineer, McLaughlin Water Engineers, LTD, submitted a FHDP application <br />for review on May 9, 2011. The application was forwarded to the Planning, Building, and <br />Health Departments on May 9, 2011. The application was returned to the applicant's <br />engineer for more information on May 23, 2011. The applicant's engineer resubmitted the <br />revised portions of the application with a response to comments on June 6, 2011. The <br />application was to the applicant's engineer on June 20, 2011 for more information. The <br />applicant's engineer resubmitted the revised portions of the application with a response to <br />comments on July 15, 2011.
