We delivered it to <br />the Division's office on August 4, 2011. We believe the remaining and outstanding <br />completeness issue is the requested survey. <br />We request the survey issue be move from a Completeness issue to an Adequacy issue. The <br />professional survey has finally been done for both pits. (It appears the originally approved 110 <br />application was greater than 9.9 acres and we will need to figure out how to modify the existing <br />operation's permit boundary so that it meets our operational needs, DRMS regulations and then <br />add the excess to the new pit.) We may need additional time to resolve the issue past the 60 days <br />allowed for completeness. If we do not meet the 60 day completeness timeline, we could be in <br />violation of the Board ordered submittal date. <br />I was in the DRMS Office on the 4 attending a pre - hearing conference. I was not able to meet <br />with you since you were in a meeting. Mr. Waldron wanted to meet with me on some other <br />matters and I briefly discussed this request with him. <br />Please let me know as soon as possible if this request may not be granted since we are close to <br />the end of the 60 day completeness date, August 22, 2011. In addition, we ask the DRMS <br />indulgence in attempting to get this permit issue resolved, particularly since Corkle Construction <br />inherited this problem which was not evident to Corkle Construction as the time of succession. <br />
