Exhibit D- Mining Plan <br />Kurtz Project permit area (OMLR Permit M1999 -006) to the north; within which <br />runs approximately 1,413± feet of conveyor (line). The remaining 3101± feet of <br />conveyor within the Kurtz Project permit area is authorized under a separate but <br />correlated Technical Revision to the Kurtz Resource Recovery and Land <br />Development Project permit. The scope of this consideration is retained under the <br />Amendment application, but financial warranty and related reclamation is detailed <br />under Exhibit L — Reclamation Costs, and encompasses the dismantling of the <br />entire system in the event of default. <br />The line runs from approximately the north 130± feet of the west boundary as <br />determined from the northeast corner of the Heintzelman permit boundary, to a line <br />bridge 50± feet to the east within property recently acquired by Varra Companies, <br />Inc. From here, the is directed nearly due north over Weld County Road 28, as <br />provided for under an approved Weld County, Colorado Right -of -Way permit <br />(pending along with a correlated Weld County USR Amendment). The 106± foot <br />span is engineered to provide for public safety considerations. <br />On the opposing side of the bridge, lies a leased area with Ready Mixed Concrete <br />Company, as detailed under Exhibit N — Legal Right to Enter. The line continues <br />from here until it crosses into the Kurtz Project permit area as described earlier. <br />The entire line of the conveyor is shown under Exhibit C -3: Conveyor Route. <br />Conveyor appearance with typical 40 foot spans and supports for the as built <br />structure are shown in the included drawings from Divide Constructors. <br />Reclamation of the line simply involves disassembly and picking it up, for with the <br />exception of the bridge footings, no other ground preparations are needed as each <br />span of the line is supported on the ground surface without tying it to concrete pads <br />or other foundations. Attending costs are detailed under Exhibit L — Reclamation <br />Costs.
