Pineda <br />Director <br />On August 1, 2011 the Division of Reclamation, Mining, and Safety (Division) received NRCS comments regarding <br />Rimrock Exploration's application for a 110d, Designated Mining Operation (DMO), application No. M- 2011 -040. <br />Those comments have been forwarded to Rimrock for their response. Per Rule 1.6.2. (1) (ii) an applicant is <br />required to give notice to the local soil conservation district prior to submission of the application to the Division. <br />Per normal protocol the Division is sending notice to the NRCS which will include the application form, legal <br />description, and location map. The rule notice unfortunately does not specify any other requirements other than <br />notice. It is hoped that the contact facilitates discussion between the applicant and NRCS on reclamation issues <br />prior to submission of an application. <br />The Division notes that the applicant has submitted a soil survey map from the NRCS website as you suggest. The <br />soil survey is required for an Environmental Protection Plan (EPP) under Rule 6.4.21 (17) (c). The map is Appendix <br />B of the application. Due to the fact that this is on Bureau of Land Management administered lands the operator <br />will have to gain a BLM approved seed mix from the Uncompahgre Field Office. A general weed plan is required <br />per Rule 3.1.10(6). If during annual inspections problematic or noxious weeds are observed, an operator is <br />required to submit formal weed control plan as a Technical Revision. This is done in conjunction with the local <br />weed management agency.
