HISTORY <br />August 2, 2011 <br />Tom Kaldenbach <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br />Re: West Elk Mine (Permit No. C -1980 -007), Technical Revision Application No. 126 (TR -126), Revised <br />Access to Proposed MDW E3- 29(CHS #60053) <br />Dear Mr. Kaldenbach: <br />Thank you for your correspondence dated July 26, 2011 (received by our office on July 28, 2011) and the <br />follow -up email sent on August 1, 2011 regarding the subject project. <br />We did receive a copy of the Limited Results Cultural Resource Inventory report (submitted by the <br />Grand Mesa, Uncompahgre and Gunnison National Forests on July 25, 2011; CHS #60046) as an <br />informational -only product. As such, we did not provide comment. However, based on the negative <br />results of the survey we would concur that a finding of no historic properties affected is appropriate <br />for the proposed project. <br />Since there is Federal agency involvement in this project (portions of the project area are located on land <br />managed by the U.S. Forest Service), please note that it is the responsibility of the Federal agency to <br />meet the requirements of Section 106 of the National Historic Preservation Act as set forth in 36 CFR <br />800 ( "Protection of Historic Properties "). <br />Therefore, should unidentified archaeological resources be discovered in the course of the project, work must <br />be interrupted until the resources have been evaluated in terms of the National Register of Historic Places <br />eligibility criteria (36 CFR 60.4) in consultation with our office. <br />Thank you for the opportunity to comment.
