The message claims that DRMS is nonresponsive to Ms. Turner and other citizens, notably a <br />Mr. Buckshot Burbridge is alleged to have left dozens of unanswered messages regarding activity at the <br />Western Fuels- Colorado, New Horizon Mine. Ms. Turner purports to have given Mr. Burbridge Al's and my <br />telephone numbers, and to date we have not received a call from Mr. Burbridge. Ms. Turner also alleges that <br />there are 34 other citizens who have written to the DRMS without a reply. <br />OSM is concerned about Ms. Turner's allegations. If true, they suggest a failure of DRMS to effectively <br />administer its regulatory program. The legal actions by Ms. Turner, while contentious, do not abdicate DRMS's <br />responsibility to administer its regulatory program. These charges of abandonment are serious, but possibly <br />groundless. Therefore, we await your reply to Ms. Turner's voice message. This year's oversight evaluation <br />will review this matter as it relates to Customer Service, which is a national measurement element of the <br />oversight review topics. <br />You are aware of Ms. Turner's continual weekly and often daily submittal of citizen complaints, some of which <br />with merit demonstrating "Reason To Believe" that have resulted in Ten -Day Notices issued to DRMS. During <br />our teleconference to discuss OSM's decision regarding the TDN of May 5, 2010, (TDN) X10 - 140 - 182 -003 we <br />discussed the leadership needed to reverse Ms. Turner's submittal of citizen complaints from OSM to DRMS as <br />prescribed by regulatory statute. <br />I suggest that this voice message become the occasion to reverse Ms. Turner's procedures for filing citizen's <br />complaints. The DRMS now has the opportunity to reach out to Ms. Turner and request that she submit any <br />further citizen complaints to the DRMS. <br />Best wishes, <br />Ken <br />1 <br />
