ARTICLE 5 - DESIGNATION AND SUCCESSION OF FIDUCIARIES <br />I nominate my wife as my personal representative. If my wife predeceases or ceases <br />to act as my personal representative, I nominate my son Shane Rudibaugh as my personal <br />representative. <br />ARTICLE 6 - POWERS OF FIDUCIARIES <br />6.1 My personal representative may perform every act reasonably necessary to <br />administer my estate. Specifically, my personal representative may retain appraisers or <br />auctioneers to assist him in the sale and distribution of my property. He or she may <br />employ attorneys, accountants, investment advisors, and other agents or assistants as <br />deemed advisable to act with or without discretionary powers and compensate them. All of <br />the expenses for retaining any of the persons listed in the foregoing sentences shall be paid <br />from the income or principal of my Estate. My personal representative shall have the <br />authority to allow Jacob Millison to continue living on my ranch property rent free in <br />return for care of the ranch livestock as needed while my Estate is probated or my personal. <br />representative may make any other arrangements he or she determines appropriate and <br />desirable for the upkeep of the ranch property and livestock until the Estate is closed. <br />6.2 In addition to all of the above powers, my personal representative may exercise those <br />powers set forth in the Colorado Fiduciaries' Powers Act as amended after the date of this <br />instrument. <br />ARTICLE 7- ADMINISTRATIVE PROVISIONS <br />7.1 I direct that no fiduciary shall be required to give any bond in any jurisdiction, and <br />if, notwithstanding this direction, any bond is required by any law, statute, or rule of court, <br />no sureties be required <br />7.2 Any fiduciary under this instrument shall be entitled to reasonable compensation <br />commensurate with services actually performed and to be reimbursed for expenses <br />properly incurred. <br />
