3. The Division received comments from the Colorado Historical Society. The letter is attached for your <br />review. Please address the comments noted in the letter and make any changes in the application as <br />necessary. <br />Exhibit D - Mining Plan (Rule 6.4.4) <br />4. The Applicant states, on page 4, Grand County has a supply of topsoil stored in the existing mine to <br />resoil the slopes with 4 to 6 inches as approved. During the pre - operational inspection, Mr. Clark <br />stated the Topsoil /Growth Medium Pile indicated on Exhibit C — Pre - mining Map of Affected Lands was <br />import material. No other stockpiles of topsoil are indicated on Exhibit C. The Operator must comply <br />with the requirements of Rule 3.1.5(9) if they intend to use topsoil generated outside of the approved <br />permit area. <br />Rule 3.1.5(9) requires the Operator to provide the following information: <br />(a) A narrative that describes the approximate location of the proposed activity <br />(b) The approximate volume of inert material to be backfilled <br />(c) A signed affidavit certifying that the material is clean and inert, as defined in Rule 1.1(20) <br />(d) The approximate dates the proposed activity will commence and end, however, such dates shall <br />not be an enforceable condition <br />(e) An explanation of how the backfilled site will result in a post- mining configuration that is <br />compatible with the approved post- mining land use <br />(f) A general engineering plan stating how the material will be placed and stabilized in a manner to <br />avoid unacceptable settling and voids. <br />5. The Applicant states, on page 5, if the soil stockpiles remain undisturbed for more than one year the piles <br />will be seeded with 3# PLS of Crested Wheatgrass per 200 square feet to prevent erosion. Crested <br />Wheatgrass is a non - native species, which is not preferred by the Division. The Division recommends the <br />seed mixture in the Reclamation Plan be used to stabilize the stockpiles. Additionally, please commit to <br />seeding the topsoil stockpiles if in place for more than 180 days. <br />Exhibit E - Reclamation Plan (Rule 6.4.5) <br />6. The Applicant states, on page 9 -10, if the topsoil piles remain undisturbed for more than a year, a <br />vegetative cover of 3 #'s /200 FT Crested Wheatgrass. Please revise this statement in accordance with <br />the Applicant's response to Question #5 above. <br />Exhibit R - Proof of Filing with County Clerk and Recorder (6.4.18) <br />Please be advised the Benson Pit amendment application may be deemed inadequate, and the <br />application may be denied on September 12, 2011 unless the above mentioned adequacy review items <br />are addressed to the satisfaction of the Division. Please provided an affidavit or receipt indicating the date on which the revised application information in <br />response to this letter was placed with the local County Clerk and Recorder for public review, pursuant to <br />Subparagraph 1.6.2(1)(c). <br />
