We note that we have made a number of changes regarding closing or <br />completing portions of the reclamation work including final pit limits and re- seeding/ <br />closeout consistent with Phase I. Please therefore expect a more formal request that the <br />one made in years past relating to the completion of this portion of the reclamation and <br />the release of this component of the financial warranty associated therewith. <br />Further, regarding any mining or reclaim activities at Shaffers Crossing and the <br />corresponding Hydrologic Balance permit Number MLRB1978-208, we note that our <br />operations are not anticipated nor planned to expose any ground water and part of our <br />original submittal to Jefferson County pursuant to Ms Kraeger - Roveys' report <br />corroborates that. We do not therefore anticipate nor expect any impact to the existing <br />hydrologic balance within the limits of our operation or during reclamation activities. <br />
