-2- <br />c. Please provide proof of notice to the owner of the surface and mineral rights of the affected land, John <br />Rich. <br />3. The Division received comments from the Army Corps of Engineers and the Colorado Historical Society. <br />The letters are attached for your review. Please address the comments noted in the letters and make any <br />changes in the application as necessary. <br />Exhibit C - Mining Plan (Rule 6.3.3) <br />4. The Applicant states, "Any extra topsoil or fill dirt will be stockpiled at (the) south corner of permit." Rule <br />3.1.9 requires topsoil to be removed and segregated from other spoil. Please commit to segregating and <br />salvaging all available topsoil at the site. <br />5. The Applicant states, "stockpiles will be shaped and sloped then seeded for protection." Please commit to <br />vegetating overburden and topsoil stockpiles if in place for more than 180 days. In addition, please state <br />the seed mixture that will be used to stabilize the piles and the rate of seeding in PLS /acre. The Division <br />recommends the seed mixture in the Reclamation Plan be used to stabilize the stockpiles. <br />6. The Applicant states, "No ground water will be encountered by this operation." Please commit to ceasing <br />mining activities immediately if ground water is encountered and backfilling the area 2 feet above the <br />ground water elevation. <br />7. The Applicant states, "There should be no overburden saved but if there is any it will be placed back in pit as <br />mining progresses ". Please confirm the final reclamation slopes (3H:1V ) will be mined at the final slope and <br />will not be constructed with backfilled overburden. <br />Exhibit D - Reclamation Plan (Rule 6.3.4) <br />8. The Division recommends a minimum of two (2) tons of mulch per acre. Please commit to mulching all <br />revegetated areas with two tons of mulch per acre. <br />9. Per Rule 3.1.10(6), please provide the Division with the methods of weed control for the site. The Division <br />recommends the Applicant contact the appropriate local weed control authority to assist with the weed <br />control plan. Please include the following information: <br />a. A list of potential noxious weed species (target species). <br />b. The control methods and treatment window for each target species. <br />c. A monitoring plan and follow -up plan for the site (i.e. when the "local weed control expert" will <br />inspect the property during the year and how follow -up treatments will be implemented following <br />the inspection.) <br />10. The Division prepared a reclamation cost estimate for the Wamsley Pit based on the information provided <br />by the Applicant and a maximum disturbance area of 3 acres at one time.
