Box 187 <br />Craig, CO 81626 <br />Re: Trapper Mine (Permit No. C- 1981 -010) <br />Proposed Decision - Technical Revision No. 108 (TR -108) <br />Dear Mr. Luke: <br />Enclosed you will find the Division of Reclamation, Mining and Safety's Proposed Decision for Technical Revision No. <br />108 at the Trapper Mine. Notice of the proposed decision will be published in the Craig Daily Press as soon as possible. <br />The first publication will initiate the ten (10) day public comment period for the Division's decision. <br />Documentation must be submitted to the Division demonstrating that a copy of the approved revision application was sent <br />to the Office of Surface Mining and the Bureau of Land Management. The material should be sent within 15 days of fmal <br />approval. <br />Please refer to the Performance Bond heading on the enclosed proposed decision form. If the amount of Bond Held equals <br />or exceeds the Revised Liability, you need not submit additional bond. However, if the Revised Liability exceeds the Bond <br />Held, please submit additional bond or rider to your existing bond that equals or exceeds the Revised Liability. This <br />Technical Revision must not be implemented until this proposed decision becomes fmal and until any required increase in <br />bond is submitted to and approved by the Division. <br />As part of the review of TR -108, DRMS asked the Colorado Division of Water Resources (DWR) to comment on the <br />application. In a letter dated April 18, 2011, Karlyn Adams of DWR (aka the State Engineers Office or SEO) raised <br />issues related to well permitting and water rights. Per correspondence between myself and Ms. Adams on July 28, <br />2011, the issues were addressed adequately in TMI' s response (letter dated July 14, 2010), with one exception. The <br />SEO requires that monitoring wells be permitted within one year of construction or that Monitoring Hole Notices be <br />provided to the SEO.
