Pineda <br />Director <br />On January 7, 2011 the Mined Land Reclamation Board (Board) issued a Board Order that required the <br />Operator for Permit No. M- 1983 -011 to provide all materials necessary to allow for Division of Reclamation, <br />Mining and Safety (Division) approval of an amendment or a conversion application to Permit No. M -1983- <br />011, in order to incorporate all lands affected by the mining operation into the approved affected area. <br />The Division received a complete 112 conversion application (CN1) on May 2, 2011. During site visits and <br />review of the materials submitted with CN1, it was noted that some of the mining disturbance lies on land <br />owned by the United States Forest Service (USFS), and that this land was not included in the proposed affected <br />area. In order to satisfy the Board Order, all lands affected by the mining operation must be included in the <br />approved affected area. In order to include the USFS land disturbed by the mining operation as part of the <br />proposed affected area, the Operator may amend the CN1 application in accordance with Rule 1.8. <br />To provide adequate time for submittal and processing of an amendment to CN1, Mt. Elbert Mining Co., L.L.C. <br />will need to submit a written request for extension of the Board ordered corrective action deadline for CN1 <br />approval. This extension request must be submitted as soon as possible, so that the public hearing process <br />regarding CN1 (pre- hearing conference to be scheduled for July 26, 27 or 28, 2011, and Formal Public Hearing <br />currently scheduled for August 10 -11, 2011) can be extended in a timely manner. <br />Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
