Case 1:08 -cv- 01624 -WJM -MJW Document 85 -1 Filed 07/11/11 USDC Colorado Page 2of <br />3 <br />Department of Energy <br />Washington, DC 20585 <br />June 30, 2011 <br />OLM -LEK- 2011 -092 <br />To: Distribution <br />Subject: Notice of Intent to Prepare a Programmatic Environmental Impact Statement for the <br />U.S. Department of Energy Uranium Leasing Program <br />• Greetings Lessees: <br />On June 15, 2011, the U.S. Department of Energy (DOE) Office of Legacy Management (LM) <br />announced its notice of intent (NOT) to prepare a programmatic environmental impact statement <br />(PEIS) for the DOE .Uranium Leasing Program (ULP) "analyze the reasonably foreseeable <br />environmental impacts, including the site - specific impacts, of the range of reasonable alternatives <br />for the management of the ULP for the remainder of the ten -year period that was covered by the <br />July 2007 PEA [programmatic environmental assessment] ". This notice was published in the <br />Federal Register on Tuesday, June 21, 2011. A copy of this notice can be found at <br />http: / /www.gpo.gov /fdsys /pkg/FR- 2011- 06- 21 /ndf/2011- 15408.pdf. Please reference this notice <br />for the details pertaining to the announcement. The notice specifies, "DOE invites comments on <br />the proposed scope of the PETS. To ensure consideration, comments must be submitted by <br />August 22, 2011." <br />The preparation of the PETS is estimated -to take from 12 -15 months to complete. Unfortunately, <br />during that time period, DOE will be unable to approve any new ground - disturbing activities on the <br />lease tracts (i.e., approve any new lessee's exploration or mining:plans). DOE recognizes the <br />inconvenience of this decision; however, it cannot be averted. <br />On apositive note, the annual royalty paid for your respective lease tract(s) for the 2011 -2012 lease <br />year ensures your lease tract(s) are in good standing, and will remain so during the PEIS <br />process. No further annual royalty will be required until the PSIS process is completed. <br />Additionally, the "reasonable diligence" portion of Article IV of each URANIUM MINING <br />LEASE agreement is hereby waived for the same time period. <br />Please contact me at (720) 880 -4338, or Mr. Ed Cotter of my contractor staff at (970) 248 -6055, if <br />you have questions concerning this matter.
