M- 1984 -013 <br />Dear Mr. Otten: <br />In an inspection report from 27 Ju y the Division of Reclamation, Mining & Safety (Division) described <br />several problems at the Mackey Mine site and laid out the corrective actions required to resolve each. The <br />Division, acknowledging the logistical difficulties in performing the corrective actions over the winter of 2010- <br />11, granted you an extension until summer of 2011 to complete the activities. Observations made during a site <br />visit conducted yesterday 27 July 2011 indicate that, other than placement of the sign required by Hard Rock <br />Rule 3.1.12, little progress has been made on the corrective actions. This letter serves as notice that unless the <br />corrective actions listed below are completed by 30 September 2011, the Division will pursue enforcement <br />actions under the Colorado Mined Land Reclamation Act. <br />1) Corrective Action #2 in Inspection Report of 27 July 2011: Safeguard the open adit portal and provide a <br />report to the Division that describes and documents the activity. <br />2) Corrective Action #3 in Inspection Report of 27 July 2011: Provide additional Financial Warranty sufficient <br />to bring the total Financial Warranty amount up to $8,162. <br />3) Corrective Action #5 in Inspection Report of 27 July 2011: Remove the refuse at the site and provide <br />photographic evidence that the cleanup was completed. <br />Be advised that placing the permit on Temporary Cessation status does not relieve an operator from his <br />obligations under the Hard Rock Rules and the aforementioned Corrective Actions. <br />I can be reached with questions at (303) 866 -3567 x8108.
