BEFORE THE MINED LAND RECLAMATION BOARD <br />STATh OF COLORADO <br />FINDINGS AND ORDER <br />IN THE MATTER OF WILDCAT MINING CORPORATION'S REQUEST FOR A <br />DEADLINE EXTENSION, File No. M-1981-185 <br />THIS MATTER came before the Mined Land Reclamation Board ( "Board ") on July 13, <br />2011 in Denver, Colorado as a consent agenda item to consider a request to extend the decision <br />deadline for processing an amendment to the 112 DMO conversion application, file number M- <br />1981 -185. <br />The Board, having considered the materials presented with this consent agenda item and <br />having been otherwise fully informed of the facts in the matter, hereby enters the following: <br />1. The Board has jurisdiction over this matter pursuant to sections 34 -32 -104 <br />through 107, and 124 of the Colorado Mined Land Reclamation Act, Article 32 of Title <br />34, C.R.S. (2010) ("Act"). <br />2. The Operator holds a permit for an underground hard rock gold and silver <br />mining operation located in section 28, Township 36 North, Range 11 West, 10 Principal <br />Meridian. The operation, now known as the May Day Idaho Mine Complex, is located <br />near the town of Mayday, in La Plata County, Colorado, permit number M -1981 -185. <br />3, The Operator has engaged in mining activities under three separate permits (the <br />May Day Mine, Permit No. M -1981 -185; the Idaho Mill, File No. M- 2006 -069; and the Idaho <br />Mine, File No. M- 2010 -003), which have resulted in multiple violations. See MV-2009-007, MV- <br />2009-033, MV-2009-035, and MV-2010-001. <br />4. On July 8, 2010, the Division and the Operator signed a joint stipulation, <br />which became a Board order on July 12, 2010, requiring the Operator to submit a <br />conversion application to convert the current 110(2) permit at the May Day Mine to a 112 <br />permit that covers all current and anticipated affected land at the May Day and Idaho <br />sites. The Operator was to provide the Division with all required materials, in adequate <br />form, to allow a final decision on the conversion application within 180 days of the <br />application filing date. <br />5, On September 29, 2010, the Operator submitted conversion application <br />CNOI ( "CN01 "), which the Division found incomplete on October 12, 2010. The <br />Division found CNO1 complete for purposes of filing on January 10, 2011 and, on that <br />date, .notified the Operator. <br />6. Approval of CNO1 will resolve violations numbers MV-2009-007, MV- <br />2009 -033, MV-2009-035 and MY-2010-001. <br />
