PERMIT #: M -1982 -015 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: July 19, 2011 <br />Financial Warranty: <br />The Division holds a financial warranty of $115,545 which is sufficient to complete reclamation at the site. The <br />Division discussed reducing the financial warranty amount with the Operator. The Operator may submit a <br />request for a reduction of the financial warranty at any time. The request must be made in writing and must <br />include an estimate of the actual cost to reclaim the site based on what it would cost an independent <br />contractor to complete reclamation. The estimate should include unit costs for reclamation activities as <br />appropriate to the operation. Upon receipt of the request, the Division will reevaluate the required financial <br />warranty amount. <br />Reclamation Success: <br />The approved Reclamation Plan specifies that three lakes would be established upon the completion of <br />reclamation. The final configuration of the site contains two lakes. The Operator informed the Division during <br />the inspection that the two smaller lakes located on the western half of the site were combined into a single <br />lake. The current configuration of the lakes was not approved by the Division. This has been cited as a problem <br />and will require corrective action by the Operator; please see the beginning of this report for additional <br />information. <br />Revegetation: <br />The Division last inspected the site on December 18, 2008 in response to a release request and found that the <br />vegetation on the site was dominated by annual weeds. During this inspection, the Division noted that grasses <br />were beginning to establish; however, the observed grass species were not a part of the approved seed mix. <br />The approved seed mix calls for planting Russian wild rye (5# PLS /Ac) and sweet clover (3.5# PLS /Ac), a copy of <br />the approved seed mix has been enclosed with this report. The planted grasses are present throughout the <br />site; however, annual weeds such as kochia are also present and threaten to out - compete the grasses. The <br />vegetation does not currently meet the performance standards outlined in Construction Materials Rule 3.1.10. <br />The lack of established vegetation and the planting of unapproved grass species have been cited as a problem <br />and will require corrective action by the Operator; please see the beginning of this report for additional <br />information. <br />During the inspection the Division observed the following noxious weeds: Canada thistle, Salt Cedar and <br />Diffuse knapweed. These weeds are listed on the State of Colorado's Noxious Weed List. According to the <br />Operator, the thistle was treated last summer with Milestone; the other noxious weeds on site have not been <br />treated. The presence of noxious weeds are considered a problem and will require corrective action by the <br />Operator; please see the beginning of this report for additional information. <br />Sediment Control: <br />The Division observed erosion of the pit slopes along the north shoreline of the eastern lake. Stormwater <br />runoff from upland areas has created a gully approximately 15 - 20 feet in length. The eroded pit slope has <br />been cited as a problem and will require corrective action by the Operator; please see the beginning of this <br />report for additional information. <br />Permit Stipulations: <br />The Division has identified a condition of the permit which must be fulfilled before the site may be released. <br />The Operator submitted Technical Revision - 03 (TR -03) to the Division on December 21, 2007. The Operator <br />committed to collecting water samples from the lakes once they were filled. The purpose of sampling the <br />water is to determine if the fuel spill has any impact on water quality. The site will not be eligible for release <br />Page 3 of 6 <br />
