ASPHALT
SPECIALTIES CO.
10100 Dallas St. • Henderson, CO 80640 • (303) 289 -8555 • Fax: (303) 289 -7707
REQUEST FOR TEMPORARY CESSATION FOR
NELSON MINING RESOURCE
DRMS PERMIT NO. M -2005 -059
ASPHALT SPECIALTIES CO., INC.
Asphalt Specialties Co., Inc. ( "ASCI ") respectfully requests the Mined Land Reclamation Board grant ASCI
a Temporary Cessation of mining activities as defined and allowed by Rule 1.13.5 of the Mineral Rules
and Regulations for the Nelson Mining Resource operation (M- 2005 -059).
Due to the continued slowdown of the construction industry in Colorado and the lessened demand for
construction sand and gravel, the Nelson mine site has not operated in a significant manner since
February 2009 with active mining, processing or reclamation activities. Loadout of aggregates from
material stockpiles occurred for some time after initial shutdown and the pit faces and floor were
stabilized, but active mining ceased at this time.
ASCI is committed to continued operation of the Nelson mine site when the economy improves in the
area of that the site serves. There are no plans to abandon the site or remove the processing equipment
(plant site) that remains.
Along with this Temporary Cessation request, a Technical Revision is being submitted (under separate
cover) to address weed control issues on a small portion of the site and to address stabilization of
topsoil stockpiles with revegatation activities to preclude erosion and to control the infestation of weeds
that could occur.
ASCI understands that the period of time since cessation of active mining and reclamation at the site
must be considered retroactive from the initial request for a 5 -year allowance of cessation and so, upon
approval of this request, ASCI realizes that unless active mining or reclamation activities resume prior to
approximately February 2014, an extension of the current cessation request /approval must be applied
for in a second notice and be approved for another 5 -year extension.
The reclamation bond currently in force to ensure Financial Warranty for reclamation of the mine sit
into a water- storage reservoir in the amount of $186,814.00 is adequate to cover the reclamation
liability.
