M -2005 -059 <br />ASPHALT SPECIALTIES CO., INC. <br />Asphalt Specialties Co., Inc. ( "ASCI ") respectfully requests the Mined Land Reclamation Board grant ASCI <br />a Temporary Cessation of mining activities as defined and allowed by Rule 1.13.5 of the Mineral Rules <br />and Regulations for the Nelson Mining Resource operation (M- 2005 -059). <br />Due to the continued slowdown of the construction industry in Colorado and the lessened demand for <br />construction sand and gravel, the Nelson mine site has not operated in a significant manner since <br />February 2009 with active mining, processing or reclamation activities. Loadout of aggregates from <br />material stockpiles occurred for some time after initial shutdown and the pit faces and floor were <br />stabilized, but active mining ceased at this time. <br />ASCI is committed to continued operation of the Nelson mine site when the economy improves in the <br />area of that the site serves. There are no plans to abandon the site or remove the processing equipment <br />(plant site) that remains. <br />Along with this Temporary Cessation request, a Technical Revision is being submitted (under separate <br />cover) to address weed control issues on a small portion of the site and to address stabilization of <br />topsoil stockpiles with revegatation activities to preclude erosion and to control the infestation of weeds <br />that could occur. <br />ASCI understands that the period of time since cessation of active mining and reclamation at the site <br />must be considered retroactive from the initial request for a 5 -year allowance of cessation and so, upon <br />approval of this request, ASCI realizes that unless active mining or reclamation activities resume prior to <br />approximately February 2014, an extension of the current cessation request /approval must be applied <br />for in a second notice and be approved for another 5 -year extension. <br />The reclamation bond currently in force to ensure Financial Warranty for reclamation of the mine sit <br />into a water- storage reservoir in the amount of $186,814.00 is adequate to cover the reclamation <br />liability. <br />
