— Request for Reclamation Amendment from Recreation Use to Developed Water Resource
Enclosed please find the response to your comments dated July 20, 2011. Your comments were
received on July 25, 2011. The decision date is July 26, 2011. If the Division determines that
additional information is required, Weld County respectfully requests a 45 -day extension. If the
Division determines that we have submitted sufficient information to grant the change of post mine
reclamation use, Weld County requests that ;a' decision be made as quickly as possible.
Comment 1: The applicant has indicated a slurry wall will be installed around the perimeter of the
existing ponds. According to the applicant, the design specifications for the slurry wall will be
prepared by the contractor who will install the slurry wall. Please note that the approval of AMO4
will change the post - mining land use to developed water resource; it will not authorize the Operator
to install a slurry wall. Slurry wall installation may not proceed until the Operator has submitted and
obtained Division approval of the design specifications for the slurry wall under a subsequent
Technical Revision.
Comment 2: The Applicant has stated that if the Poudre River Trail is damaged during the
installation of the slurry wall, then it will be repaired. The Applicant should note that the Poudre
River Trail was released from the permit area on May 22, 2003. Therefore, if the Poudre River Trail
or any other area located outside the permit boundary is affected by mining operations during the life
of the mine, then the Operator will face a possible violation of C.R.S. 34-32/5-116(4)(i) for failure tr,•
protect areas outside of the . affected land Barn slides or damage occurring during' the mining
operation and reclamation.
