Your comments were <br />received on July 25, 2011. The decision date is July 26, 2011. If the Division determines that <br />additional information is required, Weld County respectfully requests a 45 -day extension. If the <br />Division determines that we have submitted sufficient information to grant the change of post mine <br />reclamation use, Weld County requests that ;a' decision be made as quickly as possible. <br />Comment 1: The applicant has indicated a slurry wall will be installed around the perimeter of the <br />existing ponds. According to the applicant, the design specifications for the slurry wall will be <br />prepared by the contractor who will install the slurry wall. Please note that the approval of AMO4 <br />will change the post - mining land use to developed water resource; it will not authorize the Operator <br />to install a slurry wall. Slurry wall installation may not proceed until the Operator has submitted and <br />obtained Division approval of the design specifications for the slurry wall under a subsequent <br />Technical Revision. <br />Comment 2: The Applicant has stated that if the Poudre River Trail is damaged during the <br />installation of the slurry wall, then it will be repaired. The Applicant should note that the Poudre <br />River Trail was released from the permit area on May 22, 2003. Therefore, if the Poudre River Trail <br />or any other area located outside the permit boundary is affected by mining operations during the life <br />of the mine, then the Operator will face a possible violation of C.R.S. 34-32/5-116(4)(i) for failure tr,• <br />protect areas outside of the . affected land Barn slides or damage occurring during' the mining <br />operation and reclamation. <br />Comment 3: The Applicant has stated the soil amendments, seed mix, and application rate will be <br />
