BAURER, CYNTHIA S. <br />BAURER AND CARL F. EIBERGER <br />IN WELD COUNTY <br />Case Number: 05CW 158 <br />(97CW383) <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, RULING OF THE REFEREE, AND <br />DECREE OF THE COURT <br />This matter has come before the Court upon the application of Peter L. Baurer, Cynthia S. <br />Baurer, and Carl F. Eiberger ( "applicants ") to make absolute or, in the alternative, for a finding <br />of diligence on the conditional water rights associated with the Stillwater Ski Lake. The <br />application was referred to the water court referee pursuant to C.R.S. § 37-92-203(7). Having <br />made such investigations as are necessary to determine whether or not the statements in the <br />application are true, and being fully advised with respect to the subject matter of the application, <br />the Referee enters the following findings of fact, conclusions of law, ruling and decree: <br />FINDINGS OF FACT <br />1. The application was filed with the Water Clerk for Water Division No. 1 on June 30, <br />2005. The application was filed in a timely manner within the diligence period set forth <br />in the decree in Case No. 97CW383 and the April 15, 2005 order extending the deadline <br />for filing an application for reasonable diligence and/or an application to make the water <br />rights absolute. <br />
