(BCC) had filed <br />Articles of Dissolution with the Colorado Secretary of State. According to State records, the Articles of <br />Dissolution were filed on April 4, 2011. The Division has questions and comments concerning this legal action <br />taken by BCC as it relates to the Bear No. 3 Mine. <br />1. Rule 2.03.4(1) requires a statement concerning the nature of the business entity of the applicant. The <br />Bear No. 3 Mine permit application states that Bear Coal Company, Inc. is a Colorado corporation. <br />According to State records, however, BCC has begun a process of dissolving this corporation. The <br />Division requests the current status of BCC, an explanation of the filing of the Articles of Dissolution <br />and BCC's intent concerning the ownership and reclamation obligations of the Bear No. 3 Mine. <br />2. If BCC is going out of business, does BCC intend to transfer the permit to another permittee according <br />to Rule 2.08.6? If the permit is not transferred, the permit for the Bear No. 3 Mine may be in jeopardy <br />of permit revocation and bond forfeiture. <br />Please contact the Division immediately when you receive this letter to update us on the status of Bear Coal <br />Company. <br />Sincerely,, <br />b.g...-k. <br />oseph J.
