DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
July 18, 2011
Mr. Daniel Bear
Bear Coal Company
1326 War Emblem Lane
Rock Springs, Wyoming
82901 -7713
RE: Bear No. 3 Mine, Permit No. C- 1981 -033, Bear Coal Company
Status of Bear Coal Company, Request for Information
Dear Mr. Bear:
On June 9, 2011, the Colorado Department of Public Health and the Environment informed the Colorado
Division of Reclamation, Mining and Safety (Division) that the Bear Coal Company, Inc. (BCC) had filed
Articles of Dissolution with the Colorado Secretary of State. According to State records, the Articles of
Dissolution were filed on April 4, 2011. The Division has questions and comments concerning this legal action
taken by BCC as it relates to the Bear No. 3 Mine.
1. Rule 2.03.4(1) requires a statement concerning the nature of the business entity of the applicant. The
Bear No. 3 Mine permit application states that Bear Coal Company, Inc. is a Colorado corporation.
According to State records, however, BCC has begun a process of dissolving this corporation. The
Division requests the current status of BCC, an explanation of the filing of the Articles of Dissolution
and BCC's intent concerning the ownership and reclamation obligations of the Bear No. 3 Mine.
2. If BCC is going out of business, does BCC intend to transfer the permit to another permittee according
to Rule 2.08.6? If the permit is not transferred, the permit for the Bear No. 3 Mine may be in jeopardy
of permit revocation and bond forfeiture.
Please contact the Division immediately when you receive this letter to update us on the status of Bear Coal
Company.
Sincerely,,
b.g...-k.
oseph J.
