HISTORY
July 18, 2011
Jason Musick
Environmental Protection Specialist
Division of Reclamation, Mining and Safety
Department of Natural Resources
1313 Sherman St., Room 215
Denver, CO 80203
RECEIV
JUL 2 2011
,,►arnaYl•
Vanin9 4 d Sa`et1
r.
Re: Peabody Sage Creek Mine (Permit No. C- 2009 -087), Minor Revision No.4, Overland Conveyor
Geotechnical Investigations (CHS #59970)
Dear Mr. Musick:
Thank you for your correspondence dated July 7, 2011 (received by our office on July 12, 2011)
regarding the subject project.
Following our review of the documentation provided, we concur that a finding of need data is
appropriate for sites 5RT139, 5RT145 and 5RT487. In addition, we concur with your determination
that sites /isolated finds 5RT406, 5RT410, 5RT3070, 5RT3071 and 5RT3072 are not eligible for the
National Register of Historic Places (NRHP). Finally, we find that linear segment 5RT2749.2
(incorrectly noted, at times, on the site form and report as 5RT2947.2) does not support the
eligibility of the entire linear resource. Assuming these sites will be avoided by the proposed project as
described in the report and that ground disturbing activities will stay within previously reclaimed areas
and /or within existing road right -of -way, we concur that a finding of no adverse effect is appropriate.
We would also like to offer the following project specific comments:
• As a number of these sites (specifically 5RT145, 5RT406, 5RT410 and 5RT487) were last
recorded 15 years ago (or more) we recommend that these sites be fully re- recorded to current
documentation standards, rather than simply discussed in the report. Having site information
that meets current documentation standards greatly facilitates our ability to comment on the
recommended determinations of eligibility.
• Please be sure to show all survey areas on the report maps even if they fall within portions of
the project area that were previously inventoried. Ideally the survey of both sides of Fish Creek
"200 to 300m in length depending on topography" should be documented so we may include
this information in our survey database.
.IVIC CENTER PLAZA 1560 BROADWAY SUITE 400 DENVER COLORADO 80202 www.historycolorado.org
