NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Approve Technical Revision <br />Application No. 84 (TR -84) for the Colowyo Coal Mine (Permit No. C- 1981 -019), submitted by <br />Colowyo Coal Company L.P. The Colowyo Coal Company has submitted a Technical Revision for the <br />Colowyo Mine to resolve Stipulation 13. Stipulation 13 was attached to the permit as a result of TR -72 <br />and deals with establishing tall mountain shrubs and aspen planting areas at the Colowyo Mine, <br />specifically the South Taylor Pit area. This revision provides a detailed plan for the procedures and <br />possible locations for the tall mountain shrub and aspen planting areas in the South Taylor Pit. There is <br />no proposed change to the mine's disturbance boundary or permit boundary with this revision. Due to <br />changes in planting methods and seed mixes that will result from this revision, the Division estimates an <br />increase to the mine's reclamation liability. <br />The Colowyo Coal Mine is a surface coal mine located in Moffat County, approximately 28 miles south <br />of Craig, Colorado. Coal interest is Federal, and the surface affected is Federal, state and private land. <br />The permit area encompasses approximately 12,250.95 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34 -33 -101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado <br />Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, <br />Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed <br />decision may request a formal hearing before the Mined Land Reclamation Board on the proposed <br />decision. Such request must be made within ten (10) days of the initial publication of this notice, must be <br />in writing, and must state with reasonable specificity the reasons for the request and the objections to the <br />proposed decision. <br />
