July 18, 2011 <br />Travis Marshall <br />Division of Reclamation, Mining and Safety <br />101 S. 3 Street <br />Grand Junction, Co 81501 <br />Re: Reclamation report on Whitewater permit M- 1977 -129 <br />Dear Mr. Marshall - - <br />I have received a copy of your Reclamation report for property I own which <br />is currently under the reclamation permit above. This letter refers to the 63 <br />acres owned by Dale Brandon and not the 23 acres currently owned by <br />Whitewater. <br />I was along on the inspection with you, Mark and Ed Gardner and expressed <br />my desire to release the property which I own. During this inspection, the <br />areas of concern in your report were talked about and I would like to <br />address these concerns and once again state my desire for release. <br />• The vegetation is more successful around the lake edge than the upper <br />areas but these upper areas are dry land and have grasses growing at <br />least as well as other similar areas on adjacent properties. <br />• I have been contracted by Whitewater to do the weed control on my <br />property and have them well under control. The cheat grass is a <br />common growth and can be found on all of the adjacent properties. <br />The knapweed is a common growth on adjacent properties as well as <br />mine, but I have done extensive spraying of knapweed since your <br />inspection. I have also removed tamarisk from my property, not only <br />within the mined boundary but outside the boundary as well. <br />• I purposely left the old settling pond area unseeded and have worked <br />at removing vegetation from that area because it is full of fine sand <br />and is perfect for a riding arena. A riding arena requires no building, <br />just the ability to ride a horse on it. I would like the property released <br />so that I can use the property as I see fit. <br />
