Tf you discover any previously unknown historic or archeological rertntins while accomplishing the activity <br />authorized by this permit, you must immediately notify this office of what you have found We will initiate the Federal <br />and state coordination required to determine if the remains wanan a recovery effort or if the site is eligible for listing in <br />the National Register of Historic Places. <br />4. If you sell the property aeuhcialed with this permit, you must obtain the signature of the new owner in the space <br />provided and forward a copy of the permit to this office to validate the transfer of this authorization. <br />5. if a conditioned water quality certification has been issued for your project, you must comply with the conditions <br />specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is <br />attached if it contains such conditions. <br />6. You must allow representatives from this office to Inspect the authorized activity at any time deemed necessary to <br />ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit <br />Special Conditions; <br />I . To insure compensatory mitigation compliance, the document entitled Final Wetland Mitigation Monitoring and <br />Long Term Management Plan, dated April 2009, is incorporated by reference as a condition of this authorization. <br />2. To mitigate for the loss 015.58 acres of waters of the United States, you shall construct 4.95 acres of wetland and <br />5.02 acres of open waters, and will restore 0.76 acres of wetland, 0.73 acres of stream, 0.93 acres of open water, and 7.72 <br />acres of Cottonwood gallery. To insure that mitigation Is conducted according to your approved final mitigation plan, a <br />professional wetland biologist and/or river ecologist must be present during the mitigation construction. <br />3. You shall construct the compensatory mitigation prescribed by this plan concurrently with, or in advance: of, the <br />start of construction oldie authorized/permitted activity. <br />4. As indicated in the Final Mitigation Plan, mitigation related to historic impacts totals 0.93 acres. In no case shall <br />initiation of the construction of compensatory mitigation for historic impacts be delayed beyond July 15, 2010. <br />5. Construction of compensatory mitigation for historic impacts shall be completed no later than October 1, 2010. <br />6. To insure that mitigation is completed as required, you shall notify the District Engineer of the start date and the <br />completion date of the mitigation construction, in writing and no later than ten (10) calendar days after each date. <br />7. To provide a permanent record of the completed mitigation work, you shall provide a complete set of as -built plans <br />of the completed work to the Corps of Engineers. The as built plans shall indicate changes made from the original plans. <br />These as -built plans shall be provided to this office no later than 60 days after the completion of construction of each <br />phase of the project. <br />8. You shall establish and maintain in perpetuity a 20.11 -acre preserve containing 12.39 acres of created, avoided, <br />and preserved waters of the United States and 7.72 acres of restored cottonwood gallery, as depicted on the exhibit <br />entitled Keyah Grande Wetland Mitigation and Stream Restoration Schematic Plan, dated March 31, 2009, revised April <br />13, 21009. The purpose of this preserve is to insure that functions of the aquatic environment are protected. Prior to <br />construction, the Corps approved conservation easement for the preserve must be executed and recorded, <br />9. To insure that the preserve is properly managed, you shall finalize a specific and detailed preserve management <br />plan for the on -site and of site mitigation, prescavation, and avoidance areas. This plan shall be submitted to and <br />specifically approved, in writing, by the Corps of Engineers prior to engaging in any work authorized by this permit <br />This plan shall describe in detail any activities that are proposed within the preserve area(s) and the long teen funding <br />and maintenance of each of the preserve areas. <br />
